移民美国途径多 婚姻移民最稳妥

移民美国的途径很多，最稳妥可靠的当属婚姻移民。这条捷径现在也布满了荆棘，特别是对有前科的，简直就是“此路不通”。

移民局最新案例 （Matter of Jongbum PAK, Beneficiary of a visa petition filed by Jacklyn Hyonk Lee, Petitioner）定出新法：如果第一次婚姻移民，移民局拒签，拒签理由为证据不足，第二次婚姻移民，即使是真的，移民局照样可以根据第一次婚姻移民的理由，拒绝移民申请。

理由来自移民法204(c) 款：Notwithstanding the provisions of subsection (b) no petition shall be approved if (1) the alien has previously been accorded, or has sought to be accorded, an immediate relative or preference status as the spouse of a citizen of the United States or the spouse of an alien lawfully admitted for permanent residence, by reason of a marriage determined by the Attorney General to have been entered into for the purpose of evading the immigration laws, or (2) the Attorney General has determined that the alien has attempted or conspired to enter into a marriage for the purpose of evading the immigration laws。

这条规定有两个关键点：1.没有时间限制；2. 移民局可以用第二次婚姻移民申请，再旧账重提。

这个案子，按照名字看是韩国人。但这种事，在中国人中也常见。非法身份，通过跟美国公民结婚，转合法，既快有安全。

本案中，第一次婚姻申请，夫妻在婚姻面谈时，很多细节说法不一；移民局家访，美国公民居然不住在那。还有很多其他细节，都是假婚姻常见的错误。假的真不了，真的假不了。要想以假混真，不容易，不下苦功真不成。

第二次婚姻看来是真的，有牧师主持，而且牧师也目睹二人同住。但移民局还是抓住第一次婚姻不放，最后以第一次婚姻不实为由，拒绝。

这起案件目前局限于婚姻申请。会不会用于政治庇护？

如果真的存在第一次婚姻移民，由于证据不足，被移民局拒签；现在找到了真爱，需要通过婚姻移民，怎么办？可以办，但准备材料要从第一次婚姻开始。第一次婚姻解释不清楚，那最好作罢。移民门槛越来越高。
